دور المعرفة و الخبرة في تحقيق المناط

Abstract

This role is particularly evident in social issues, where the impact of such employment is clearly demonstrated, since it can not be determined by legal judgment to prove or deny only by building on specialized scientific and technical advice. الاجتهاد في النظر الأصولي؛ إما أن يكون في فهم المراد اللهي من النص، وغايته استنباط الحكم من أدلته، وإما أن يكون في تنزيل الحكم على واقع المكلفين وهو ما يعرف بتحقيق المناط؛ ولئن اعتنى الأصوليون بالقسم الأول أيما عناية، فإن القسم الثاني لا يزال بحاجة إلى معالجة مستمرة لأنه يقوم على أرض متحركة وواقع متغير، وفي هذا السياق جاء هذا البحث ليٌسهم في إجلاء مسالكه وأدواته. فيٌعنى البحث بالكشف عن مدى تحقق المناطات الكلية في الفروع والجزئيات وذلك بالاحتكام إلى جملة من المسالك النقلية والعقلية والاستعانة بجملة من القواعد المعينة على استيعاب أحوال المكلفين وظروفهم بما يحقق مقاصد الشارع في التشريع من صون مصالح الخلق. كما اعتنى البحث بإبراز الدور الأساس للمعرفة والخبرة كأدوات كاشفة عن الواقع محلّ التنزيل من حيث أنها تسهم في التوصيف الدقيق للظروف والملابسات المحتفة بالواقعة، وهذا ما يضمن التحقيق الأمثل للمناطات في محالّ التنزيل. ويبرز هذا الدور أكثر في القضايا الاجتماعية بشكل خاص حيث يظهر فيها وبجلاء أثرذلك التوظيف، إذ لا يمكن أن يتقرر مناط الحكم الشرعي فيها إثباتا أو نفيا إلا بالبناء على الاستشارة العلمية والفنية المتخصصة.
