السياسة الجنائية لمكافحة الجريمة المنظمة في التشريع الجزائري

Abstract

Organized crime is one of the most dangerous crimes at the national and international levels. The recent growth in the activities of organized criminal groups has led to the intensification of the efforts of the international community to approve an international document criminalizing this type of activities through what has been adopted within the Palermo Convention and its accompanying protocols. In consolidation of the contents of the agreement, the Algerian legislator wanted to amend the legislative system to suit it, by activating a criminal policy based on the criminalization of many activities of organized criminal groups and the adoption of procedural mechanisms that are compatible with the specificity of the crime. This isn't enough criminalization in the internal law alone to limit the development of crime, but it must be emphasized international cooperation between countries and the consolidation of efforts among them to draw effective strategies to combat it and limit its spread. تعد الجريمة المنظمة من اخطر الجرائم على الصعيد الوطني و الدولي و قد ادى تنامي انشطة الجماعات الاجرامية المنظمة في الاونة الاخيرة لتكثيف جهود المجتمع الدولي لاقرار وثيقة دولية تجرم مثل هذا النوع من الانشطة من خلال ما تم اعتماده ضمن اتفاقية باليرموا و البروتوكولات المكملة لها. و تكريسا لما تضمنته الاتفاقية عمد المشرع الجزائري على موائمة المنظومة التشريعية بما يتلاءم معها و ذلك من خلال تفعيل سياسة جنائية قائمة على تجريم العديد من انشطة الجماعات الاجرامية المنظمة و اقرار اليات اجرائية تتلاءم و خصوصية الجريمة. هذا و لا يكفي التجريم الداخلي لوحده للحد من تنامي الجريمة و انما يقتضي الامر تكريس و كفالة التعاون الدولي بين الدول و ترسيخ الجهود فيما بينها لرسم استراتيجيات فعالة للتصدي لها و الحد من انتشارها.
