تأثير سريان اتفاقية تريبس على ضمان حقوق الملكية الصناعية ودورها في تحسين التنمية في البلدان النامية

Abstract

وضعت الاتفاقية الخاصة بالجوانب المتصلة بالتجارة من حقوق الملكية الفكرية التزامات عدة على كاهل الدول الأعضاء فيها، قصد ضمان حماية فعالة لعناصر الملكية الصناعية، أهمها إلزام الدول بتوفير مدة حماية قانونية لهذه الحقوق لا تقل عن مدة الحماية التي وفرتها الاتفاقية، بالمقابل فقد منحت حقوقا عدة لهذه الدول، والتي تنعكس إيجابا على حماية مختلف عناصر الملكية الصناعية ، وهذا قصد الحد من الحقوق الاحتكارية التي يتمتع بها مالكيها، بما يتوافق وسياسة كل دولة عضو في هذه الاتفاقية، وهو ما يطرح التساؤل حول فعالية هذه الأحكام، وقدرتها على حماية عناصر الملكية الصناعية، والدور الذي تلعبه في دعم التنمية للبلدان النامية؟ وتتلخص هذه الدراسة في وصف وتحليل الأحكام التي جاءت بها الاتفاقية في الجانب المتعلق بحماية عناصر الملكية الصناعية، بغية الوصول لتنمية حقيقية داخل البلدان النامية. The trips agreement on trade related aspects of intellectual property rights places obligations on members to protect the elements of the industrial property. Such as; it obligates the members to provide a period of legal protection of the industrial property rights stated in the agreement. Moreover: it dictates rights to these countries. This is for limiting the monopolistic rights by its owners with the internal politics of each member in the trips agreement. This may poses the query of effectiveness of this judgments and its ability to protect the elements of the industrial property? This study aims to describe and analyze the agreement judgments of protecting the industrial property, in order to achieve an effective development in the developing countries.
