المهام الجديدة لصندوق الضمان والكفالة المتبادلة في الترقية العقارية

Abstract

صعوبة توفير السكن للمواطنين من طرف الدولة نظرا للتكلفة الباهظة، جعلها تبحث عن طرق بديلة للتمويل، فاستعانت بالمرقين العقاريين سواء الخواص أو العمومين، وسمحت لهم بالتعاقد وفقا لتقنية البيع على التصاميم قصد إشراك المقتنين في عملية التمويل، ونظرا لخطورة هذه التقنية، فقد تم استحداث صندوق الضمان والكفالة المتبادلة في الترقية العقارية، ومنح له المشرع العديد من الصلاحيات والمهام التي طرأت عليها العديد من التغييرات بمناسبة تعديل قانون الترقية العقارية. ويعتبر اكتتاب تأمين لدى صندوق إلزاما لا يقبل الاتفاق على مخالفته، ومن جهة ثانية صندوق الضمان ملزم هو الآخر حسب الحالة إما بضمان إتمام إنجاز المشروع أو تعويض أقساط المشترين المسددة من طرفهم في حالة حدوث خطر يتطلب ذلك، وهي النقاط التي سنحاول دراستها في هذا العمل العلمي بالاستعانة بالمنهج الوصفي. The difficulty of providing housing for citizens on the part of the state due to the high cost made it look for alternative ways of financing, so it sought help from real estate promoters, and allowed them to contract according to the technique of selling on designs in order to involve the owners in the financing process. In view of the seriousness of this technique, the guarantee fund and mutual bail in real estate promotion was created, The legislator granted him many powers that have undergone many changes. This guarantee fund is also obligated, depending on the case, either to guarantee the completion of the project or to compensate the buyers' in the event of a risk that requires this, these are the points that we will try to study in this scientific work, using the descriptive method.
