Abstract

تطبيقا لمبدأ الحرية التعاقدية يجوز للمتعاقدين أن يضمنا تعاقدهما أي شرط طالما أن هذا الشرط غير ممنوع قانونا، إلا أنه في ظل التطور في مجال التكنولوجيا والمعلومات، وفي ظل الممارسات الاحتكارية في ظل الاقتصاد الحر، انتشرت العقود النموذجية حيث ينفرد العون الاقتصادي بصياغتها بعيدا عن الرقابة، فيقوم بوضع شروط تعسفية مجحفة لتحقيق مصالحه، غير مهتم بالأضرار التي قد تقع على الطرف الآخر، مما استوجب وضع آليات تؤدي إلى توفير حد أدنى من الحماية للمستهلكين في الفترة التي تسبق التعاقد عبر الانترنت، ومن بين هذه الآليات حقه في مكافحة الشروط التعسفية.
