Résumé:
The privileged position that Parliament enjoys in comparable
constitutional systems, given its role in protecting the constitutional base and
in defending fundamental rights and freedoms through its legislative and
supervisory function, imposes guarantees that ensure its independence from
other authorities in the embodiment of the principle of separation of powers.
It has always been adopted by all Algerian constitutions, as the
constitutional founder has been given a range of guarantees to ensure that
deputies and members of the legislative authority as representatives of the
people's will work independently, freely and away from pressures and
inducements that can adversely affect their parliamentary work and
performance.
These guarantees vary, whether they are in the form of duties that the
legislative institution has to respect and abide by, or in the form of rights it
enjoys in the exercise of its functions throughout its legislative term.
However, the constitutional and legal texts and the practical realities
have revealed to us the ineffectiveness of these guarantees, due to many
factors associated with the ambiguity of the texts and the gaps in them, the
persistence of numerous restrictions and obstacles, and the mistaken
perception among parliamentarians of these guarantees, which have been
interpreted as personal privileges and not a necessity for a job; It is so
impressively devoted to the overwhelming control and domination of the
executive over the legislative authority by its organs, affairs and functions.
Therefore, we hope that in the future, especially in light of the changes
and reforms that Algeria is witnessing, the Algerian legal system as a whole,
including the parliamentary legal system, will be reformed and amended to
witness a strong and truly independent parliament to be at the level of the
aspirations and aspirations of the people. إن المكانة المتميزة التي يحظى بها البرلمان في الانظمة الدستورية المقارنة بالنظر للدور الذي يلعبه في حماية القاعدة الدستورية وفي الدفاع عن الحقوق و الحريات الاساسية من خلال وظيفته التشريعية و الرقابية، تفرض توفير الضمانات التي تكفل استقلاليته عن السلطات الأخرى تجسيدا لمبدأ الفصل بين السلطات. وهو مادرجت على الأخذ به جميع الدساتير الجزائرية، حيث منح المؤسس الدستوري مجموعة من الضمانات تكفل للنواب وأعضاء السلطة التشريعية كممثلين للإرادة الشعبية العمل في استقلالية وحرية وبعيدا عن الضغوطات والإغراءات التي من شأنها التأثير بشكل سلبي على عملهم وأداءهم البرلماني. و تنوعت هذه الضمانات سواء أكانت في صورة واجبات تقع على المؤسسة التشريعية بنوابها و أعضائها وجوب إحترامها و الإلتزام بها أو في صورة حقوق يمتعون بها نظير ممارستهم لوظيفتهم طيلة عهدتهم التشريعية . بيد أن النصوص الدستورية والقانونية و الواقع العملي كشفوا لنا عدم فاعلية هذه الضمانات بفعل عديد من العوامل ترتبط بغموض النصوص والثغرات الموجودة فيها، واصطدامها بقيود وعراقيل عديدة، و المفهوم الخاطئ السائد بين البرلمانيين بخصوص هذه الضمانات التي فسرت على أنها امتيازات شخصية و ليست ضرورة لممارسة وظيفة ،وهو ما كرس بشكل لافت سيطرة وهيمنة طاغية للسلطة التنفيذية على السلطة تشريعية بأجهزتها وشؤونها ووظائفها. وعليه نامل مستقبلا خاصة في ظل ماتشهده الجزائر من تحولات واصلاحات أن يتم اصلاح وتعديل المنظومة القانونية الجزائرية ككل بما فيها المنظومة القانونية البرلمانية حتى نشهد برلمانا قويا و مستقلا فعليا ليكون في مستوى طموحات وتطلعات
الشعب.
