Since the end of the sixties of the twentieth century, the environment and its problems have become the most important challenge to human survival and well-being, and since the guarantee of the human right to the environment means the preservation of his right to life, as a basic right, the majority of international conferences, declarations and treaties at present Human rights have thus evolved from one stage to another, from the declaration of individual rights to the declaration of collective rights to the declaration of common rights. Right to development, Right to a healthy environment ... etc., but these new rights, especially the right to a healthy environment, has been widely debated about their nature and legal value, whether they are merely ethical principles to which States abide by their own volition, or are fundamental human rights recognized at the international and national level. The question is whether the right to the environment is a standing right, like other human rights, and, if so, the adequacy and effectiveness of international efforts to integrate the environmental dimension into human rights? منذ نهاية ستينيات القرن العشرين، باتت البيئة ومشكلاتها أهم تحدي لبقاء الإنسان
ورفاهيته، وما دام أن ضمان حق الإنسان في البيئة يعني الحفاظ على حقه في الحياة، كحق من
حقوقه الأساسية، فإن جل المؤتمرات والإعلانات والمعاهدات الدولية في وقتنا الحالي، نجدها تربط
بين مسألة البيئة وحقوق الإنسان، وبذلك تطورت حقوق الإنسان من مرحلة لأخرى، ومن الإعلان
عن الحقوق الفردية إلى الإعلان عن الحقوق الجماعية إلى الإعلان عن الحقوق المشتركة، حيث
ظهرت طائفة جديدة من حقوق الإنسان، عرفت بحقوق الجيل الثالث، تشمل الحق في السلم، الحق
في التراث المشترك، الحق في التنمية والحق في البيئة الصحية...إلخ، إلا أن هذه الحقوق الجديدة،
لاسيما الحق في البيئة الصحية، قد أحاط بها جدل واسع حول طبيعتها وقيمتها القانونية، فيما إذا
كانت مجرد مبادئ أخلاقية تلتزم بها الدول بإ رادتها الإختيارية، أم هي حقوق أساسية للإنسان
معترف بها على المستوى الدولي والوطني، مما يستوجب تعزبزها وحمايتها، بتوفير الوسائل الدولية
الكفيلة بذلك، من خلال تفعيل دور المنظمات الدولية والإقليمية، وكذا أجهزة الرقابة الدولية
والإقليمية لحمايتها، والسؤال المطروح هو إذا: هل الحق في البيئة يعد حقا قائما بذاته، كباقي
حقوق الإنسان الأخرى؟ واذا كان الأمر كذلك ما مدى كفاية وفعالية المجهودات الدولية الرامية إلى
إدماج البعد البيئي ضمن حقوق الإنسان؟
