human rights and fundamental freedoms which promote awareness and

knowledge and technological gap between their countries, societies and
developed countries, which are clearly visible and reflected on the quality
and availability of goods and products, as well as the ease of working life
and the well-being of their daily lives. Which is imperative for those who
call for the need to remove the restrictions that contribute to depriving
them of benefiting from the fruits of scientific and technological progress
in the world in various fields and aspects of life, especially economic,

and artistic aspects of intellectual property, States, institutions or moral
persons target the most intellectual works protected by the patent system. يبرز موضوع الحق في الوصول إلى المعرفة كأحد المواضيع المستحدثة في ميدان دراسة
العلوم القانونية، وذلك كنتاج للتغييرات الحاصلة على مستوى العالم، لاسيما في مجال إنفاذ حقوق
الإنسان وحرياته الأساسية المختلفة، التي تعزز الوعي والإدراك بها من طرف الأفراد والمجتمعات،
لاسيما داخل الدول النامية والأقل نموا مؤخرا، وبالأخص بعد بروز وتزايد اتساع الفجوة المعرفية
والتكنولوجية بين بلدانهم ومجتمعاتهم ونظريتها من الدول المتقدمة، والتي تظهر جلياً وتنعكس على
جودة السلع والمنتجات ووفرتها، وكذا سهولة الحياة العملية ورفاهية الحياة اليومية لدى تلك الدول
والمجتمعات، وهو ما حتم على هؤلاء المناداة بضرورة فك القيود التي تساهم في حرمانهم من
الاستفادة من ثمار التقدم العلمي والتكنولوجي في العالم، في شتى مجالات ومناحي الحياة، لاسيما
الاقتصادية منها والثقافية والاجتماعية، ويستهدف هؤلاء بالأساس فكرة وخيار حماية حقوق الملكية
الفكرية، وٕاذا كان الأفراد منهم أو الأشخاص الطبيعية يستهدفون الشق الأدبي والفني لموضوعات
الملكية الفكرية، فإن الدول والمؤسسات أو الأشخاص المعنوية يستهدفون أكثر الأعمال الفكرية
المحمية بموجب نظام براءة الاختراع.
