دور المقاصد في تفسير نصوص الشريعة الإسلامية

Abstract

اقتضت حكمة الله سبحانه و تعالى ان تكون شريعة الاسلام مستجيبة لمقتضيات الفطرة منسجمة مع الطبائع السليمة تهدف الى تحقيق مصالح الخلق في المعاش و المعاد، و يعد القران الكريم و السنة النبوية الشريفة مصدران اساسيان في شريعة الاسلام المباركة؛ و ان تفسير تلك النصوص و استنباط الاحكام الشرعية منها من اهم القضايا التي تتوجب على اهل الاجتهاد لمعرفة احكام الله سبحانه و تعالى و ما تحويه من المعاني العظيمة و الحكم الجليلة. و تعتبر مقاصد الشريعة من اهم الوسائل و الاليات التي تعين على فهم نصوص الشريعة و تفسيرها؛ و قد جاءت هذه الاطروحة لتعالج جانبا مهما من جوانب الشريعة الاسلامية و الذي يتعلق باثر و اهمية المقاصد في تفسير النص الشرعي؛ و توصلت الى عدة نتائج تدور على نتيجتين رئيسيتين هما: - ان التفريط في الاخذ بالمقاصد و الغفلة عن اعتبار العلل و المعاني كما هو حال الظاهرية يؤدي الى الجمود على الظواهر و اغفال المقاصد الشرعية، و الغلو في اعتبار المقاصد و الافراط في الاخذ بالمصالح خطر جسيم يؤول الى اهدار النصوص و الغاء دلالاتها و معانيها المرادة شرعا. - اعتبار المقاصد في الاجتهاد و تفسير النصوص بانضباط و عدم المبالغة يؤدي الى الفهم السليم للنصوص و الظفر بالمقاصد المرادة من الخطاب الشرعي، و يفتح بابا للاجتهاد الذي يمثل مظهر التفتح و التجديد و مسايرة الظروف و الاحوال لاستيعاب المستجدات و احتوائها. . The wisdom of the Almighty Allah requires for the Islamic Shariah to be responsive for the instinct requirement in harmony with (humans) healthy characters. The Shariah also seeking to accomplishing the human intrests in this life and hereafter, both the holy Quaran and the honorable Sunnah are considered the two fundamental references the (sources) in the blessed Islamic Shariah; the explanation of those script and eliciting the Sharia rulings among the ultimate concerns (issues) which the Islamic scholars have to be highly familiar whith in order to truly knowing the Almighty Allah’s judjements and the great implied meanings as well as the scared glorious wisdoms. The purposes of the Islamic law are considered one of the important means and mechanisms which helps into understanding and grasping the Shariah script and its explanation; this thesis has come to treat one of Islamic Shariah’s key, sides which has to do whith effects and importance of purposes in explaining the Islamic script; it has reached various out comes which can be reffered and surround thes two main important ones: - the negligence of adopting and taking the Islamic purposes and being inattentive in considering causes and meaning as it is the case with "Aldhahiriah" school leads into stagnation of the Islamic outer demonstrations, and being inattentive about the Islamic purposes; it also leads into being hyperbolic into considering the purposes (aims); and the excess of taking the good and the benefits and the interests of Shariah judjments is a great danger which leads into script waste and ignorance andultimately nullifying and invalidating its wanted Islamic meanings and semantics. - Considering the purposes in striving and explaining the script faithfully without exaggeration leads to a real good texts understanding and gaining the intended purposes from the Islamic religious speech or statement; and opens a wide door for the fiathful diligence which represents and embodies one of the important aspects of openness, removation and getting along with different circumstances and condition to absorb the lastest and changes and containing the new developments.
