الحماية القانونية للأصناف النباتية الجديدة في القانون الجزائري و الإتفاقيات الدولية

Abstract

تعد الأصناف النباتية الجديدة من الإبتكارات المهمة في العصر الحديث، الأمر الذي جعل منها أحد أهم مواضيع الملكية الصناعية و هي الأهمية التي دفعت الى التفكير في كيفية اضفاء الحماية القانونية لهذه الأصناف حتى لا تذهب جهود مبتكريها سدى. و تحضى الأصناف النباتية الجديدة بالحماية القانونية على المستوى الوطني من خلال القانون 05-03 و على المستوى الدولي من خلال عدة اتفاقيات دولية أهمها اتفاقية اليوبوف و اتفاقية تريبس اضافة الى اتفاقيات الحماية الاقليمية. يقدم هذا البحث دراسة شاملة لحماية الأصناف النباتية ابتداء من تعريفها الى شروط حمايتها و نطاق الحقوق المحمية و كذا آليات الحماية على المستوى الوطني، كما يقدم دراسة تحليلية للاتفاقيات الدولية المعنية بحماية هذه الأصناف سواء اتفاقيات عالمية أو اقليمية. و تلخص الدراسة في الأخير الى مجموعة من النتائج التي تتضمن حوصلة لجميع ما تم دراسته و تحليله من نصوص قانونية، كما تنتهي الى مجموعة من التوصيات التي تهدف بالأساس إلى تعزيز آليات الحماية القانونية لهذه الأصناف . New varieties of plant are considered to be one of the most important innovations in the modern era, which made them one of the important issues of industrial property. It is the importance that prompted thinking about how to give legal protection to these varieties so that the efforts of their innovators do not go in vain. New varieties of plant enjoy legal protection at the national level through Law 05-03 and at the international level through several international convention, the most important of which are the UPOV Agreement and the TRIPS Agreement, in addition to regional protection conventions. This research presents a comprehensive study to the protection of plant varieties starting from its definition to the conditions of their protection and the scope of protected rights as well as protection mechanisms at the national level, as well as an analytical study of the international conventions concerned with the protection of these varieties, whether global or regional conventions. The study finally summarizes a set of results that include a summary of all the legal texts that have been studied and analyzed, it ends with a set of recommendations aimed basically at strengthening the legal protection mechanisms for these varieties.
