مبادئ التنمية المستدامة في القانون الدولي للبيئة

Abstract

The relation between the environment and development has been characterized by two main stages, the stage of contrast and dissonance, in which there was a prospering belief that continuing on the path of development leads with no doubt to the destruction of environment, and preserving the environment most definitely consists of stopping the wheel of development. Considering the huge necessity for both, development and environment in the survival and the evolution of human race, which cannot be reached without the conservation of the environment and the sustainability of its resources. It was necessary to move on to a new stage in which compatibility, balance and reconciliation must be found between these two necessary demands for human life. International efforts to reach this goal has led to the crystallization of the idea of sustainable development and its enshrining in the instruments of international environmental law. The necessity for implementing this new concept and transferring it from a mere circulating term in political discourses to practical reality called for the application of its basic principles. Some of which are proactive and technical such as the principle of preventive action and the precautionary principle, and some are therapeutic and interceptive such as the polluter pays principle. Moreover, some of them are related to development policies as the principle of integrating environmental considerations in development policies, the principle of intergenerational and intragenerational equity, which includes the protection of environmental rights for future generations, the sustainability and equitable use of natural resources. As well as a set of other sub-principles such as the principle of poverty eradication, the principle of cooperation in building and strengthening capacities, the principle of common but differentiated responsibilities, and the principle of participation, which are the main principles that we deal with in researching the topic of “Sustainable development principles in international environmental law”. تميز التطور التاريخي للعلاقة بين البيئة و التنمية بمرحلتين اساسيتين، مرحلة التضاد و التنافر التي ساد خلالها الاعتقاد بان الاستمرار في التنمية يؤدي حتما الى تدمير البيئة، و الاصرار على حماية البيئة يعني وقف عجلة التنمية، و نظرا لكونهما ضروريتين حتميتين لبقاء الانسان و نمائه، الامر الذي لا يمكن ان تحقيقه الا بالمحافظة على البيئة و استدامة مواردها، فقد كان من الضروري الانتقال الى مرحلة جديدة، يتحقق من خلالها التوافق و التوازن و الانسجام بين هذين المطلبين الضروريين للحياة البشرية. و قد ادت الجهود الدولية لتحقيق هذا الهدف الى تبلور فكرة التنمية المستدامة و تكريسها في القانون الدولي للبيئة، كما دعت ضرورة انفاذ هذا المفهوم الجديد و نقله من مجرد مصطلح متداول في الخطابات السياسية الى الواقع العملي الى تطبيق مبادئه الاساسية، و التي منها ما هو تقني استباقي، كمبدا الوقاية و مبدا الحيطة، او تدخلي علاجي كمبدا الملوث الدافع، و منها ما هو مرتبط بسياسات التنمية، كمبدا ادماج الاعتبارات البيئية في سياسات التنمية، و مبدا الانصاف بين الاجيال و داخل الجيل الواحد، و الذي يشمل حماية الحقوق البيئية للاجيال المقبلة، و استدامة استخدام الموارد الطبيعية، و استخدامها المنصف، كما تندرج ضمنه مجموعة من المبادئ الفرعية الاخرى كمبدا القضاء على الفقر، و مبدا التعاون في بناء و تعزيز القدرات، و مبدا المسؤوليات المشتركة و المتباينة، و مبدا المشاركة، و هي المبادئ الرئيسية التي نتناولها بالبحث في موضوع "مبادئ التنمية المستدامة في القانون الدولي للبيئة".
