الإستدلال بالقواعد و الضوابط الفقهية في الحكم على نوازل المعاملات المالية المعاصرة

Abstract

هذه الرسالة التي جاءت بعنوان " الاستدلال بالقواعد و الضوابط الفقهية في الحكم على نوازل المعاملات المالية المعاصرة" قسمتها إلى تمهيد و أربعة فصول أساسية تتلخص فيما يلي: أولا: الاستدلال بالقواعد و الضوابط الفقهية المقصود في البحث هو:" آلية إجرائية تعتمد على النظر في القواعد و الضوابط الفقهية لجعلها دليلا يستند إليه للتوصل إلى الأحكام الشرعية للنوازل و المستجدات الفقهية، و مدركا يؤخذ به في التعليل و الترجيح". ثانيا: الأصل صحة الاحتجاج بالقواعد و الضوابط الفقهية و هو الجاري عليه العمل قديما و حديثا عند الفقهاء، و أن القواعد الفقهية ليست على منزلة واحدة من حيث القوة و الرتبة و الاعتبار و الاحتجاج. ثالثا: عملية الاستدلال بالقواعد و الضوابط الفقهية تخضع لمجموعة من الضوابط: 1- ضوابط متعلقة بالقاعدة الفقهية المراد الاستدلال بها، كسلامة معناها و استنباطها و صحة مصدرها، و موافقتها لمقاصد الشريعة، و عدم معارضتها لمقطوع به من كتاب أو سنة أو إجماع. 2- ضوابط متعلقة بالفرع الفقهي المراد تطبيق القاعدة عليه، بأن يخلو من الاجتهاد السابق و يتحقق فيه مناط القاعدة و معناها. 3- ضوابط متعلقة بالمجتهد المتصدي للاستدلال بالقواعد و الضوابط الفقهية ، كأهليته للاجتهاد و قدرته على فهم الواقع و النظر في المآل. رابعا: تخضع عملية الاستدلال بالقواعد و الضوابط الفقهية لمنهج واضح المعالم مطبق من قبل الفقهاء القدامى و المعاصرين و قد بين البحث معالمه. خامسا: تبين أثر القواعد و الضوابط الفقهية في عملية الاستدلال و الترجيح و ذلك بالتطبيق العملي لها في الحكم على بعض نوازل المعاملات المالية المعاصرة. This dissertation, which came under the title "Inference with the rules and regulations of jurisprudence in judging the calamities of contemporary financial transactions," is divided into a preface and four main chapters that are summarized as follows: First: Inference with jurisprudential rules and controls. The purpose of the research is: “a procedural mechanism that relies on looking at jurisprudential rules and controls to make it a guide upon which to reach the legal rulings of the emerging issues and jurisprudential updates, and a guide to be taken into account in reasoning and weighting.” Second: The origin is the validity of invoking the rules and regulations of jurisprudence, and it is the current practice in the past and modern among the jurists, and that the jurisprudential rules are not of the same status in terms of strength, rank and consideration. Third: The process of inference with jurisprudential rules and controls is subject to a set of controls: 1- Controls related to the jurisprudential rule to be inferred, such as the accuracy of its meaning, its deduction, the correctness of its source, its agreement with the purposes of Sharia, and its non-contradiction of a categorical part of the Quran, Sunnah or consensus. 2- Controls related to the jurisprudential branch to which the rule is to be applied, that it is devoid of previous ijtihad and that the premise of the rule and its meaning are fulfilled. 3- Controls related to the mujtahid who seeks to infer the rules and regulations of jurisprudence, such as his eligibility for ijtihad and his ability to understand reality and consider fate. Fourth: The process of inference with jurisprudential rules and controls is subject to a clear-cut approach applied by ancient and contemporary jurists, and the research has shown its features. Fifth: Showing the impact of jurisprudential rules and regulations on the process of inference and weighting, by applying them in practice in judging some of the emerging issues of contemporary financial transactions.
