حماية التنوع البيولوجي في البحر الأبيض المتوسط على ضوء القانون الدولي العام و التشريع الجزائري

Abstract

إن موضوع حماية التنوع البيولوجي في البحر الأبيض المتوسط على ضوء القانون الدولي العام والتشريع الجزائري من المواضيع الهامة التي إستحوذت على الاهتمام الدولي، والوطني نظرا لإبعاد هذا الموضوع الاقتصادية والتنموية والسياسية والاجتماعية على شعوب العالم عامة، وعلى الدول المتوسطية والجزائر خاصة نتيجة للتزايد المأساوي في معدلات الانقراض للأحياء البحرية ، مما أنذر بوجود أزمة بيولوجية عالمية كل هذه المعطيات جعلت المجتمع الدولي يسارع لإبرام عدة إتفاقيات دولية عالمية واقليمية مدعمة بأجهزة مؤسساتية تسهر على تنفيذ تدابير الحماية ، وعلى راسها الأمم المتحدة ووكالاتها المتخصصة وفي طليعتها منظمة الأغذية والزراعة لحماية هذه الموارد الحية وترشيد إستغلالها . وبإعتبار الجزائر دولة متوسطية تعاني كثيرا من ويلات تدهور التنوع البيولوجي البحري بحيث أصبحت النظم الايكولوجية غير قادرة على التجديد التلقائي في معظم مناطقها البحرية مما عجل في وضع ترسانة قانونية، وان كانت في طور التكوين تسهر على تنفيذها أجهزة مؤسساتية على المستوى المركزي والمحلي بمشاركة مجموعة من الهيئات الاستشارية ، والتي لن يكتمل دورها إلا بإشراك مختلف تنظيمات المجتمع المدني كالجمعيات البيئة دون أن ننسى دور وسائل الإعلام في نشر الثقافة، والوعي البيئي لدى كل فئات المجتمع بضرورة حماية التنوع البيولوجي البحري لصالح جيل الحاضر والأجيال المقبلة. L’objet de cette recherche traite l’étude et l’évaluation de la compatibilité des efforts nationaux et internationaux dans le domaine de la protection de la diversité biologique dans la mer méditerrané. Au premier chapitre, nous avons étudié le concept de la diversité biologique maritime, l’un des nouveaux concepts adoptés par le droit général international. Nous avons également étudié son importance, ses composants et les éléments qui le menacent, nous avons essayé d’identifier les efforts internationaux dans le domaine de la protection de la diversité biologique maritime représentés par un ensemble de conventions internationales et régionales, ainsi que le rôle majeur joué par les organisations internationales et régionales dans le domaine de la protection de la diversité biologique maritime en général et au niveau de la mer méditerrané en particulier. Au deuxième chapitre, nous avons étudié la protection nationale de la diversité biologique maritime indiquée par le cadre législatif en Algérie et les crimes et délits administratifs en cas d’infraction, nous avons également estimé les organisations administratives les plus importantes, chargées de la protection de cette diversité au niveau central et local à la fois, en outre, les organisations administratives assistantes dans le domaine de la protection de la diversité biologique maritime. Nous avons étudié aussi le rôle des associations de l’environnement, et les médias dans le développement et l’installation de la culture environnementale associée à la protection de la diversité biologique maritime afin de la préserver aux futures générations. This research deals with the study and the evaluation of the compatibility of the international and national efforts in the field of the protection of the biological diversity in the Mediterranean Sea. In the first chapter, we have examined the notion of the marine biological diversity which is considered one of the new imminent concepts to the general international law, as we have studied its importance, components and the threatening elements facing it, then we tried to identify the international efforts the field of marine biological diversity represented by a set of international and regional conventions, in addition to the major role played by the international and regional organizations in the field of marine biological diversity in general and the Mediterranean sea in particular. In the second chapter we have studied the national protection of the marine biological diversity represented by the legislative frame in Algeria and the administrative crimes and offences resulted by breaking it. We have also dealt with the most important administrative organizations in charge of the protection of this diversity both on central and local levels, in addition to the assisting administrative authorities in the field of marine biological diversity. We have studied the role played the environmental associations too, and that of the media in the development and installation of the environmental culture associated with the protection of the marine biological diversity to preserve it to the future generations.
