منح حق الامتياز الفلاحي على سبيل المطابقة في التشريع الجزائري

Abstract

في إطار تطهير العقار الفلاحي ومن منظور توسيع القاعدة الإنتاجية بكسب أراضي جديدة صالحة للزراعة وتأمين مستغليها وربطهم بها، تم بموجب القرار الوزاري المشترك المؤرخ في 29/11/2022 المحدد لكيفيات وآجال مطابقة الأراضي التي تم استصلاحها الشروع في منح الأراضي المستصلحة التابعة للأملاك الخاصة للدولة في إطار الامتياز على سبيل المطابقة لفائدة كل مستغل يثبت خدمته للأراضي وتجسيده عليها استثمارات ذات طابع فلاحي، شريطة ألا تكون تلك الأراضي موضوع تعيين وتحديد ومنح قانوني سابق قبل صدور المرسوم التنفيذي رقم 21/432 المؤرخ في 04/11/2021 المحدد لشروط وكيفيات منح الأراضي التابعة للأملاك الخاصة للدولة للاستصلاح في إطار الامتياز في الجريدة الرسمية للجمهورية الجزائرية الديمقراطية الشعبية، وألا تكون تلك الأراضي موضوع منازعات خاصة أو نزاعات بين المستغلين.Within the framework of purifying the agricultural property and from the perspective of expanding the productive base by acquiring new arable lands and securing and linking their exploiters to it, according to the joint ministerial decision of 11/29/2022 specifying the modalities and deadlines for matching the reclaimed lands, the start of granting the reclaimed lands belonging to the private domain of the state in The framework of the concession in conformity with each exploiter whose service and embodiment of agricultural investments are proven on it, provided that it is not the subject of designation, identification and legal granting before the issuance of Executive Decree No. 21/432 of 04/11/2021 specifying the conditions and modalities for granting lands belonging to the private property of the state for reclamation within the framework of the concession, And not be the subject of private disputes or disputes between the exploiters.
