عـن استحداث صفـة المقاول الـذاتي في القانـون الجـزائـري

Abstract

بغرض تشجيع الشباب على ولوج المجال المقاولاتي وتنظيم النشاطات المقاولاتية المتعلقة بالتكنولوجيا الحديثة، استحدث المشرع الجزائري صفة قانونية لها دور محوري في ممارسة تلك النشاطات؛ ألا وهي صفة المقاول الذاتي، وذلك بموجب القانون رقم 22-23 المتضمن القانون الأساسي للمقاول الذاتي. وعليه يكمن الهدف من هذه الدراسة في تسليط الضوء على مختلف الأحكام القانونية التي كرسها المشرع الجزائري للمقاول الذاتي بموجـــب القانون أعلاه لتقدير مدى نجاعتها، وفعاليتها ورصد أهم ما يثار بشأنها من إشكالات. لأجل ذلك تم تحديد الإطار العام للمقاول الذاتي، من خلال تعريفه، وبيان أهم الحقوق الممنوحة له، وكذا مختلف الالتزامات التي فرضها عليه هذا القانون الأساسي، إضافة إلى شروط وكيفيات تسجيله في السجل الوطني للمقاول الذاتي. ولقد تم التوصل إلى أن تلك الأحكام القانونية، قد تخللتها العديد من النقائص التي من شأنها أن تجعل المنظومة القانونية التي كرسها المشرع الجزائري لصفة المقاول الذاتي، غير متكاملة الأحكام، وبالتالي تؤدي إلى عدم تحقيق الهدف المنشود منها. To encourage youth to access the entrepreneurial sector, and organizing the entrepreneurial activities of the modern technology; the Algerian legislator has introduced a legal status which has a pivotal role to exercise these activities; namely the independent contractor, according to the law N22-23 containing the Organic Law of the independent contractor. The purpose of this study is therefore, to shed light on the various legal provisions devoted by the Algerian legislator to the contractor under the above law; To overestimate its efficacy, effectiveness and look into the problems raised theron. For that; the general framework of the independent contractor was defined through its definition, demonstration the importance of its granted rights, as well as the different commitments imposed by this Organic Law, and the conditions and modalities to registrant it in the national registry of the independent contractor. Those legal provisions has been reached, but they are punctuated by several shortcomings, which will make the provisions of the legal system introduced by the Algerian legislator to the independent contractor; non-integrated, and thus prevent to achieve its objective
