قـراءة في صياغـة الأحكام المشتركـة للتبليـغ الرسمـي

Abstract

إنّ الاهتمام بمسألة الصياغة القانونية ينعكس على وضعية القواعد القانونية التي ينبغي أن تكون في منتهى الوضوح والدقة، وسهولة الفهم عند عامة الناس، وقابلة للتطبيق بسلاسة، وينصرف موضوع الصياغة إلى بحث القانون من جانب الشكل والمضمون معا، وهذا ما يبرر إيجاد دراسات تناقش الأحكام المشتركة التي تفيد في مدونة تتصف بالترابط والدقة؛ تغني عن التكرار، وتوحّد التفسير، تفاديا للتأويلات الخاطئة أو تنزيل النصوص على وجه غير سليم، أو تنافي المرونة في الشكليات التي تمتاز بها قوانين الإجراءات المدنية الحديثة. لذلك تتركز هذه الورقة على تفكيك النصوص المنظمة للتبليغ الرسمي، من حيث الصياغة الخارجية التي تُعنى بمنهجية المشرع في ترتيب مواد هذا الموضوع ظاهرا، وعلاقتها نصوصها ببعضها البعض، ثم من حيث موضوعها، كما تؤُمُّ إلى استمداد الملاحظات المشتركة والتي يمكن تعميمها على جميع أبواب القانون؛ فتكون بذلك مادة لصياغة نصوص واضحة ومتكاملة وكافية، تتصدى لمشاكل الواقع، وتسهم في تفعيل وظيفة التبليغ الرسمي وتحقيق غايته. The interest in the issue of legal drafting is reflected in the status of the legal rules that should be extremely clear and precise, understandable and smoothly applicable by the general public. The issue under investigation is devoted to examining the law in terms of both form and content. However, this justifies the previous studies that discuss common rulings useful in a coherent and accurate record. It also abstains repetition and unifying interpretation for the sake of avoiding misunterpretation or issuing improper legal texts that contradicts the flexibility in the formalities of the procedural modern civil laws. Therefore the present investigation sheds light on the deconstruction of the organized texts officially transmitted in terms of external wording dealing with the legislator’s way in arranging the articles of this subject outwardly, and their relationship to each other from hand, and from the other hand their content. The study also aims at generalizing common observations to all sections of the law so that it would be subject for the formulation of clear, integrated and adequate texts that address daily life issues and contribute to activating the function of official notification and achieving its goal.
