خصوصية حمايـة أسماء النطاق في التجارة الإلكترونيـة

Abstract

تهدف الدراسة إلى بيان أهمية أسماء النطاق في مجال التجارة الالكترونية، مع إبراز دور المشرع الجزائري في توفير الحماية اللازمة لهذه العناوين سواء المدنية أو الجزائية من خلال تحديد أهم العقوبات المقررة للأفعال التي من شأنها تشكل اعتداءات على أسماء النطاق، متوصلين إلى جملة من النتائج أهمها بساطة العقوبات التي أقرها المشرع في مثل هذه الجرائم مقارنة بجسامة الاعتداءات الواقعة عليها.The study aims to demonstrate the importance of domain names in the field of electronic commerce and highlighting the role of Algerian legislature in providing the necessary protection to such addresses, both civil and penal, by defining the most important penalties for acts that may constitute attacks on the domain names; The most important of these results is the simplicity of the legislature's penalties for such offences, as opposed to the gravity of the attacks
