التـزام شركات البتـرول بحمايـة البيئـة ضمن العقد النفطـي

Abstract

تسعى الدول المنتجة للنفط إلى استغلال هذه الثروة التي تعتمد عليها بشكل شبه كلي لإرساء كيانها الاقتصادي، ووسيلتها في ذلك التعاقد مع شركات النفط المؤهلة تقنيا وماليا من التي تقدم قدرا كافيا من الضمانات لتنفيذ التزاماتها التعاقدية المتعلقة بصلب المشروع النفطي، أو المتعلقة بحماية البيئة من مخلفات هذا المشروع، واحترام القوانين واللوائح التي تضعها الدولة المنتجة، بهدف ضمان الرقابة على مخلفات المشروع وتأثيراته البيئية وإحداث التوازن بين ضرورة استغلال الثروة النفطية وضرورة الحفاظ على المحيط البيئي الآمن، لذلك كانت الالتزامات البيئية للشركة النفطية أهم ما تُعنى به الدولة في العقد النفطي تماشيا مع تشريعها الداخلي في مجال المحروقات ومع الاتجاه الدولي الهادف إلى تكريس نشاط اقتصادي صديق للبيئة . وقد حاولنا من خلال هذه الدراسة، إبراز الالتزامات البيئة لشركات النفط ضمن عقودها مع الدولة، وتطور هذه الالتزامات وما تضعه الدولة من جزاءات لمخالفتها عبر النصوص التشريعية والتنظيمية، ومدى كفاية هذه النصوص لتحقيق الاستفادة من النفط توافقا مع مبادئ التنمية المستدامة. The oil-producing countries seek to exploit this wealth, on which they depend almost entirely to establish their economic entity, and their means in that is contracting with technically and financially qualified oil companies who provide a sufficient amount of guarantees for the implementation of their contractual obligations related to the core of the oil project or related to environmental protection from This project waste, and respect for the laws and regulations set by the producing country with the aim of ensuring control over the project’s waste and its environmental impacts and achieve a balance between the necessity of exploiting the oil wealth and the necessity of preserving a safe environmental environment. Therefore, the environmental obligations of the oil company were the most important thing that the state concerned with in the contract oil, in line with its internal legislation in the field of hydrocarbons and with the international trend aimed at devoting environmentally friendly economic activity. Through this study, we have tried to highlight the environmental obligations of oil companies within their contracts with the state, the development of these obligations, and the penalties imposed by the state for violating them through legislative and regulatory texts, and the extent of the adequacy of these texts to achieve benefit from oil in accordance with the principles of sustainable development.
