الترخيص الإداري كآلية لحماية البيئة في التشريع الجزائري - رخصة البناء نموذجا

Abstract

تهدف هذه الورقة البحثية لإبراز رخصة البناء كآلية قبلية لحماية النظام العام بصفة خاصة والبيئة بصفة عامة، خاصة وأنَّ المُشَرِّعَ الجزائري نظَّم أُطُرًا تشريعية من أجل تحقيق ذلك، هذا في إطار إجراءات سواء كانت وقائية أو ردعية، لذا سوف ترتكز دراستنا على الترخيص الإداري وعلاقته بحماية البيئة، مع التركيز على رخصة البناء كنموذج، باعتبارها تُرتِّبُ أثرًا قانونيًّا للمستفيد أو الإدارة مانحة الرخصة، كما أنَّها أسلوب وقائي وحمائي مُسبق للحدِّ من التأثير على تلوث البيئـة.This research paper aims to highlight the building permit as a tribal mechanism to protect public order in particular, and the environment in general, especially since the Algerian legislator organized legislative frameworks in order to achieve this, within the framework of measures, whether preventive or deterrent. Therefore, our study will be based on the administrative permit and its relationship to environmental protection, with a focus on the building permit as a model, as it creates a legal effect for the beneficiary or the administration granting the license, as well as a precautionary and protective method to reduce the impact on environmental pollution.
