السياسة التشريعية للحد من الجرائم الأسرية

Abstract

يعتبر القانون انعكاس للمجتمع و ثمرة من ثماره ، ذلك أن القانون إنما ينشأ لتنظيم مختلف العلاقات الاقتصادية و الثقافية و الاجتماعية التي تنشأ في إطار المجتمع ، و لأن الأسرة تعتبر الخلية الأساسية لبناء المجتمع ، أحاطها المشرع الجزائري بإطار قانوني يضبط علاقة أفرادها فيما بينهم و يكفل حمايتها من كل سلوك يحدث إخلال بالضوابط و القيم و التي يقوم عليها استقرار هذه الأسرة . و في إطار تنظيم و ضبط العلاقات الأسرية التي تنشأ بين مختلف أفراد الأسرة من زوج و زوجة ، الأصول و الأبناء و البنات، عمل المشرع على إقرار حماية جنائية لها ضد عدد من السلوكات التي اعتبرها تشكل جرائم على نحو الحماية الجنائية للعلاقة الزوجية، الحماية الجنائية للعلاقة الأبوية ، الحماية الجنائية للأبناء.The law is seen as a reflection of society and a fruit of its fruits, because the law is created to regulate the different economic, cultural and social relations that arise within the framework of the society, and because the family is considered as the The basic unit for the construction of society, the Algerian legislator has surrounded it with a legal framework which controls the relations of its members among themselves and guarantees its protection from each behavior violating the values on which the stability of this family is based.
