Abstract

جريمة إساءة استغلال الوظيفة، هي فعلا جريمة ذات طبيعة خاصة، اقرها المشرع معيارا لتطويق جرائم الفساد المرتكبة، خاصة أن أفعال الموظف العمومي الخارقة للنصوص القانوني والتنظيمية المعمول بها، متعددة ومتنوعة وبالتالي نموذجها القانوني هل مستوفي المعايير والمبادئ المفروضة قانونا، لاسيما مبدأ شرعية النص التجريمي ؟ لا جريمة ولا عقوبة بغير قانونThe abuse of functions is indeed an offence in particular character, it confessed by the legislator as criterion of surrounding corruption committed .Particularly , the acts of the official who exceeded the applicable legal and regularly texts are multiple , different and varying .Consequently , does it satisfy the conditions or criterions and principles imposed by law ? (there is no offense or punishment without law).
