Abstract

إن رغبة المجتمع الدولي في إنشاء محكمة جنائية دولية مستقلة وقوية وعادلة لم يجسدها نظام المحكمة الجنائية الدولية الذي جعل منها جهازا تحت وصاية ورقابة مجلس الأمن بما أقره له من صلاحيات تتعلق بالإحالة التي كشف الواقع توظيف مجلس الأمن لها لأغراض سياسية وكذلك ما أقره له من صلاحيات تعطل أداء المحكمة كالتي تخص وقف المتابعات والتحقيقات.
