الجريمة الدولية في ظل التشريع الإسلامي - طبيعة المفهوم وسبل الوقاية-

Abstract

ينطلق هذا المقال من حقيقة تعثر الأمن الإنساني في المجتمع الدولي نتيجة فشل العدالة الدولية الجنائية في التصدي للجرائم الدولية، وبناء على ذلك راح يبحث عن مقاربة أخرى، وقد شكل التشريع الإسلامي تلك المقاربة البديلة باعتباره يراهن على السبل الوقائية للحد من الجريمة الدولية من خلال تكريس مبادئ العدل والمساواة من جهة، والنهي عن الظلم وإحاطة فلسفة الجهاد بضوابط من جهة أخرى. ورغم الاعتراف المبدئي للأمم المتحدة بتلك المقاربة من خلال قيامها بتعليق نص الآية الثالثة عشر من سورة الحجرات في مقرها، فإنه يتوجب على المجتمع الدولي الاستفادة من المنهج الوقائي للتشريع الإسلامي بصورة فعلية بعيدا عن مزاعم الإسلاموفوبيا. This document relies on the fact that human security and safety in today ‘s society are not achieved because of the failure of the international criminal justice in its confrontation to international crimes. Given this situation, the inter- approach community has been seeking for another adequate an alternative and a global approach which bets on preventive ways to put on end to international criminality through the conservation of the justice principles and that of equality on are hand; the fight injustice and the binding of the “djihad philosophy” by clear regulations on the other hand. Despite preliminary U.N. acknowledgment of this approach in hanging the text of the “ 13th verse of the sourate El-Houdjourate” in its headquarters, it is the duty of the international community to take advantage efficiently of the preventive approach linked to islamophobia.
