عمليات التلقيح الإجباري ونظام المسؤولية المترتبة عنها

Abstract

نتيجة لما تشهده الجزائر وكل البلدان المقارنة من انتشار الأمراض المعدية وكثرة الأوبئة، أدى إلى ضرورة استحداث وسائل فعالة تحمي الصحة العامة للأفراد وذلك بمحاربة هذه الأمراض والوقاية منها، ومن بين هذه الوسائل هي القيام بعمليات التطعيم (التلقيح) الإجباري، وقد أعطى لها المشرع أهمية كبيرة وذلك بجعلها إجراء إجباري يجب على كل شخص القيام به، إلا أنه قد تحدث مضاعفات وأضرار غير متوقعة سواء كانت نتيجة خطأ القائم بها أو بدون خطئه. ولأجل كل هذا جاءت هذه المقالة لدراسة النظام القانوني لعمليات التلقيح الإجباري وكذا تبيان نوع المسؤولية المترتبة عنها وتحديد المسؤول عنها.As a result of what Algeria and the developing countries are witnessing, the spread of contageous diseases and epidemics leads up to the exigency of developing the efficient means in order to protect the induviduals' public health through combating these diseases with good prevention. The compulsory vaccination is among these efficient methods. Besides, the legislator has given a great importance to vaccination by making it a compulsory procedure so that every person must do it. However, it sometimes happens when these vaccination cause some side effects and unexpected damages whether a result of mistake or not. In consequence, this article is about studying the legitimate system of compulsory vaccination as demonstrating the kind of responsability with its results and selecting the responsability person about it.
