Abstract

بادرت السلطة الجزائرية إلى تضمين دساتيرها حماية لحقوق الملكية الفكرية، وباعتبار الدستور يمثل المرجعية الأم لقوانين الجمهورية فإن دسترة حقوق الملكية الفكرية يجعلها في مقام القانون الأسمى للدولة وهذا ما ينعكس إيجابا على السياسة المتبعة في ترقية وحفظ هاته الحقوق. فالدستور يلعب دورا أساسيا هي تنمية حقوق الملكية الفكرية ويوفر فرصا للمبدعين والمخترعين من أجل المبادرة والابتكار على أرضية صلبة ومستقرة تضمن لهم حماية وحفظ حقوقهم المادية والمعنوية.The Algerian Authority took the initiative to include its constitutions to guarantee the protection of its intellectual property and as the constitution represents the mother reference of the republic's laws including the intellectual property in the constitution makes of it the superior law of the state, and this is what is reflected positively of the followed policy in the promotion and preservation of these rights. So the constitution plays a vital role in promoting and developing the rights of the intellectual property, and offers opportunities for inventers and artists for the sake of initiative and creativity on a solid and stable platform that guarantees to them their rights material and moral ones.
