حماية حقوق الملكية الصناعية للمستثمر الأجنبي في التشريع الجزائري

Abstract

إن تطور النظام القانوني للاستثمار، أوجب توفير الحماية اللازمة للمستثمر وخاصة المستثمر الأجنبي وذلك من أجل استقطاب أكبر عدد من رؤوس الأموال الأجنبية وقد وضع المشرع الجزائري اهتمامه على حماية حقوق الملكية بكل أصنافها ومن بينها حماية حقوق الملكية الصناعية وما تتعرض له من سطو وتقليد غير مشروع، وذلك بتكريس الحماية المدنية والجنائية للمستثمر الأجنبي وهذا في ظل المنافسة غير المشروعة والتي تهدد ملكية هذا الأخير، وعليه كان لابد من وجود تنظيم قانوني محكم أو سن أحكام ردعية من شأنها حماية الملكية الصناعية للمستثمر سواء كانت مسجلة أو غير مسجلة.The evolution of the legal system for investment obliged an adaptation and sophisticated in the way of providing the necessary actions for the investor protection especially the foreign investor in order to attract the largest number of foreign capital, and that’s what makes the Algerian legislator consider the protection of property rights with its guilds as one of the important interest, including the protection of industrial property rights and from all the problems that may occur such as the burglary and illegal copying throughout the providing of civil and criminal protection for foreign investors especially when the unfair competition had been spread and became as threatening to their property, therefore an obligation of create tight legal regulation or impose provisions deterrence had been raised for the benefits of protect industrial property of the investor whether it was registered or unregistered.
