إختصـاص المحـاكـم الـدوليـة المبنـي على ضـابـط الجنسيـة في مسـائـل الـزواج المختـلـط

Abstract

يلعب ضابط الجنسية دورا فعّالا في حل مشاكل تنازع الإختصاص القضائي الدولي إذ بموجبه تتحدّد المحكمة المختصة دوليا بالنظر في الكثير من المنازعات المرتبطة بالزواج المختلط، فينعقد الإختصاص لمحكمة جنسية المدعي أو المدعى عليه. غير أن هذا الإختصاص يبقى مقيّدا وترد عليه إستثناءات. ونظرا لفاعليته، وحفاظا على الدور الذي يؤدّيه، إهتم التشريع بتنظيمه.The nationality factor plays an active role in resolving conflict issues within the jurisdiction of the international court, in effect pursuant to this agent, the international court will be determined to address many disputes of mixed marriage, the jurisdiction of nationality court determined by nationality of plaintiff or defendant. However, this jurisdiction is limited, and responds exceptions. Because of its effectiveness, and to preserve its role, the legislation concerned regulating it.
