نظــام تسليـم المجـرميـن في ظـل التعـاون القضـائـي الـدولـي

Abstract

نتطرق في هذا البحث إلى نظام تسليم المجرمين الذي يعد مظهرا من مظاهر التعاون القضائي الدولي وهو آلية ناجعة للتصدي للجريمة، إذ يساهم في ضمان عدم إفلات المجرمين من العقاب، رغم مغادرتهم لمكان ارتكاب الجريمة إلى إقليم دولة أخرى، ولقد ازدادت أهميته في العصر الحديث، لأن معظم الاتفاقيات الدولية المتعلقة بالتعاون القضائي الدولي لمكافحة الجريمة الخطرة تتضمن أحكاما تتعلق بتسليم المجرمين، على النحو الذي يراعي احترام سيادة الدول فيما بينها، ولقد صادقت الجزائر على العديد من الاتفاقيات الدولية الثنائية والمتعددة الأطراف في هذا المجال، لأن التشريع الداخلي لا يكفي لوحده لتفعيل هذا النظام، كما أن المنظمة الدولية للشرطة الجنائية آلية بارزة وفعالة في توطيد التعاون الدولي الرامي إلى ضبط وقبض المجرمين وتسليمهم للدولة الطالبة من خلال مصادقة الدول على ميثاقها، وهي تساهم في تعديل قوانين الدول الخاصة بالتسليم من خلال الدراسات والبحوث التي تقوم بها في هذا الشأن.This study examines the extradition system, which deemed as a manifestation of the international judicial cooperation, also as an effective mechanism for dealing with crimes. It considerably contributes to ensuring that criminals do not escape impunity even though they have left the place where their crimes committed into the other state territories. The most of the international conventions in terms of the international judicial cooperation that aim to confront to serious crimes including extradition provisions, which base on the sovereignty respect between states. In this Area, Algeria has ratified several bilateral and multilateral international conventions, because the Interior legislation is not sufficient to trigger this kind of systems. As for the International Criminal Police Organization (ICPO) is an important and effective mechanism for strengthening international cooperation aimed to controlling, apprehending criminals and extraditing them to the requesting State throughout its ratification of the Charter. Moreover and in this regard, it contributes to amending the laws of States for extradition through studies and research.
