تسبيـب القــرارات الإداريــة دراسـة مقـارنة بيـن الجـزائر وفـرنسا

Abstract

لتسبيب القرارات الإدارية أهمية بالنسبة للأفراد والإدارة على السواء، فكما أنه ضمان للحقوق والحريات من تعسف الإدارة، يعتبر سببا لنجاعة العمل الإداري، كما يسهّل مهمة القاضي الإداري خاصة في رقابة المشروعية الداخلية للقرارات الإدارية. رغم ذلك لم يتقرر مبدأ التسبيب الوجوبي للقرار الإداري في الجزائر إلا بموجب المادة11من القانون06/01المتعلق بالوقاية من الفساد ومكافحته، التي فرضت تسبيب القرارات الصادرة في غير صالح المواطن، وهو غير كاف لتجسيد المبدأ فعليا في مقابل الثراء التشريعي والقضائي الفرنسي في هذا الموضوع. The causation of administrative decisions is important for the administration and as well as for the individuals in protecting their rights and freedoms against the abuse of power. It causes the perfection of administrative action and specifically, it eases the judicial control of the internal legality of the administrative decisions. Despite of this significance, the principle of the obligatory motivation of administrative decisions was only adopted in Algeria by article 11 of law 06/01. This article is not sufficient for the implementation of the principle compared to the French legislation and judicial system which is very rich and full of articles concerning this theme.
