حماية الروابط العائلية في القانون الدولي الإنساني

Abstract

تؤدي النزاعات المسلحة إلى تشتت العائلات وتسبب لأفرادها معاناة كبيرة، لهذا يضمن القانون الدولي الإنساني حماية الروابط العائلية، حماية تشمل جانبين: الأول هو الحفاظ عليها بوضع آليات وقائية تحول دون تفكك وحدتها بسبب النزاعات المسلحة، والجانب الثاني هو إعادة جمع الشمل العائلي الذي قد تتسبب في تشتيته.Armed conflicts lead to the dislocation of families, and cause great suffering to its members. Accordingly, international humanitarian law protects family ties based on two grounds: (1) to maintain family ties and establish preventive mechanisms to avoid disruption of family ties because of armed conflict; (2) the reunification of families which can be dispersed because of several conflicts.
