سيـاسات الأمـن والدّفـاعِ عـن الأوطـان (دراسـة فقهيّـَة مقـارنـة)

Abstract

يلقي الإسلام على الدولة عبئاً كبيراً ومسؤولية عظمى للقيام بالوظيفة المناطة بها في الحفاظ على الأمن بكل مفاهيمه وصوره ومستوياته، فلا يجوز أن تغفل عن اتخاذ كل الأسباب والسياسات التي تحافظ بها على كيانها ونظامها وأمنها، وتواجه بها التحديات الخارجية. وهذا ما نحاول إقامة دعائمه وإرساء مبادئه في هذا البحث. وينتظم البحث في مقدمة وتمهيد وأربعة مباحث تتناول: إعداد القوة المادية والأدبية، ونظرية الرَّدْع، والاستطلاع وجمع المعلومات والتعرُّف على العدوِّ، والحزْم في العلاقات الدولية، ومراعاة العزة، وأثر الأمن في الحصانات الدبلوماسية. ويسلك منهجًا وصفيًا استقرائيًا مقارنًا، يقابل آراء وأقوال الفقهاء –رحمهم الله- بأحكام القانون الدوليِّ وما عليه العمل المعاصر عند الحاجة إلى ذلك. The state has been brought a major responsibility by Islam in order to achieve its basic value and which allows him to ensure security in all its different concepts, shapes and levels. It's why, it is not permissible to neglect the strategies, policies and politics that keep its entity, security and system. And with which the state can face external challenges, and this what we try to put its concepts in this research paper. The work is divided into an introduction, preamble and four chapters in which we find: the preparation of moral and material power, deterrence theory, bringing information about the enemy, strength in international relations, respect of dignity, the impact of security on diplomatic immunity. The research is based on a descriptive and comparative notation improved by scholars' saying -R.I.P- putting into consideration international contemporary law.
