دور مجلس فض المنازعات في تسوية منازعات عقود الإنشاءات الدولية

Abstract

مجلس فض المنازعات هو شكل من أشكال الوسائل البديلة لفض المنازعات، وخصوصا في عقود الإنشاءات الدولية التي تنظمها عقود الفيديك ( أي العقود التي تصدر عن الاتحاد الدولي للمهندسين الاستشاريين)، وقد ظهرت هذه المجالس في الشروط العامة للفيديك في نوفمبر 1996 م بإدخال ملحق لطبعتة الرابعة الصادرة عام 1987م، وقد ظهرت الطبعة الأخيرة للفيديك عام 1999 م متضمنة تنظيمًا متكاملا لعمل تلك المجالس. والقرارات التي تصدر عن هذه المجالس ما هي إلا قرارات ذات مصدر عقدي، وهو اتفاق الأطراف فيما بينهم، فهم الذين يحددون نطاق قوة هذا القرار، وعلى ذلك فإن هذا القرار له الأثر القانوني نفسه الذي يكون للاتفاقات العقدية بين الأطراف.Dispute Adjudication Board is one of Alternative Dispute Resolution, especially in international construction Contracts, which included FIDIC contracts (contracts issued by the International Federation of Consulting engineers), these boards have emerged in the general conditions of FIDIC in November 1996 to enter an extension of the fourth edition published in 1987, the last edition of the FIDIC appeared in 1999, with an integral organization of work of these Board. and the decisions issued by this Board, which is only decisions of a contractual source, is an agreement between the parties between them, which determine the scope of the power of the said decision, and therefore, this decision has the same legal effect as the contractual agreements between parties.
