Abstract

تؤدي المصارف دورًا هامًّا في الحياة الاقتصادية، وتتجلى هذه الأهمية من خلال طبيعة العمليات التي تختص بها. ونظرًا لتميز العمليات المصرفية وحساسيتها فإن المشرع الجزائري سعى إلى وضع نظام قانوني يتوافق مع طبيعة النشاط المصرفي، بهدف الابتعاد عن أي خلاف أو تعارض متصل بمضمون هذه العمليات أو آثارها. لذلك جاء قانون النقد والقرض ليحدد بكل وضوح مجال اختصاص المصارف سواءً ما تعلق بالعمليات الأساسية من تلقي الأموال من الجمهور، أو منح القروض أو إنشاء وسائل الدفع وتسييرها، أو ما تعلق بالعمليات التابعة التي تتمثل أساسًا في عدد من الخدمات المصرفية التقليدية. بالإضافة إلى إيجاد عدد من التشريعات والنصوص التنظيمية التي تحكم العمليات المصرفية الإلكترونية بمختلف أنواعها. The banks play an important role in the economy through the different banking operations they perform. Given the complexity and sensitivity of banking operations, the legislator has instituted a legal system that is compatible with the nature of banking activity, in order to avoid any dispute relating to bank transactions. That’s why, the law on currency and credit has clearly clarified the scope of the banks procedure by defining fundamental banking operations, namely: The acceptance of the public funds, the granting of credit and the creation of payment resources and their management, in addition to the definition of certain related transactions that the banks can deal with. The lawmaker has introduced specific legislation, through the adoption in recent years of panoply of statutory texts regulating electronic banking operations.
