الحمايـة القانونيـة لبرامـج الحاسـب الآلي بيـن التشريع الجـزائـري والاتفـاقيـات الـدوليـة

Abstract

يشهد العالم تطورات هائلة في كافة المجالات وهي تطورات متلاحقة قد يصعب على الإنسان في كثير من الأحيان متابعتها، ولعل أهم هذه التطورات التي شهدتها البشرية تتمثل في ظهور الحاسب الآلي والذي أدى ظهوره وانتشاره إلى إحداث ثورة حقيقية في المعلومات، ولقد صاحب الانتشار الواسع لاستخدام الانترنيت وتزايد حجم التعامل عبرها نموا مضطردا في الجرائم المرافقة لهذا الاستخدام، ولما كان النظام القانوني يُعنى بالتصدي لجميع الظواهر الإجرامية هذا ما دفع بالمشرع الجزائري إلى سن قوانين داخلية تهدف إلى توفير الحماية اللازمة لهذه البرامج فضلا عن الجهود الدولية التي ساهمت ولها أثر كبير من أجل توفير تلك الحماية وذلك من خلال إبرام اتفاقيات دولية من أجل الوصول إلى الهدف المنشود. The world is witnessing tremendous developments in all fields, which are successive developments that may be difficult for people to follow. The most important of these developments in humanity is the emergence of computers, whose emergence and spread led to a real revolution in information. The volume of dealing is a steady growth in the crimes associated with this use, and as the legal system is concerned with dealing with all criminal phenomena, this prompted the Algerian legislator to enact internal laws aimed at providing the necessary protection for these programs as well as international efforts which And has a significant impact to provide such protection through the conclusion of international agreements in order to reach the desired goal.
