| Résumé: | تلعب الضمانات البنكية دورا في تسهيل إبرام وتنفيذ الصفقات العمومية الدولية، بما تمنحه للمقاولين ورجال الأعمال من ائتمان لدى الجهة المعلنة عن المناقصة لقبول التعامل معهم. وقد أشار المرسوم 15-247 إلى جملة من هذه الضمانات، لكنه لم يتناول بشكل صريح مصطلح "خطاب الضمان" والمتعارف عليه لدى الدول العربية.Bank guarantees play a role in facilitating the conclusion and execution of international public transactions, giving entrepreneurs and businessmen the credit of being accepted to deal with the project owner. Decree 15-247 refers to a number of these guarantees, but does not explicitly address the term "guarantee letter", which is customary in Arab countries. |
