Abstract

لقد أدى التطور الهائل في مجال الإتصالات إلى استخدام الوسائل الإلكترونية في ابرام عقود التجارة الدولية، وإذا كان الاصل في تسوية المنازعات معقود للسلطة القضائية التي هي إحدى السلطات الرئيسية في الدولة، إلا أن هذه الوسائل لا تلائم مقتضيات التجارة الدولية التي تتميز بالسرعة، لذلك صار من الضروري البحث عن آليات أخرى تكون أكثر فاعلية في حل المنازعات الناشئة عنها. ولعل أفضل الوسائل سرعة في تسوية المنازعات هي المفاوضات الإلكترونية؛ إذ يتوصل أطراف النزاع إلى تسوية ومرضية للطرفين عن طريق المحاورات والمناقشات، والتي تجري بطريقة إلكترونية عبر شبكات الإتصال الحديثة والتي تتميز بالسرعة مقارنة بالمفاوضات التقليدية, يضاف إلى ذلك أنها لا تحتاج إلى إلتقاء الأطراف المتنازعة وجها لوجه، وإنما تكون كافة إجراءات المفاوضات الإلكترونية عن طريق استخدام الوسائل الحديثة للإتصال.
