البنية الإجرامية للمرأة

Abstract

تتساءل الدراسة عن إشكالية الإجرام النسوي التي أثبتت حضورها في ميدان العلوم الجنائية، كمقاربة تحليلية للنوع الاجتماعي ضمن إطار الإنسان الشامل، على اعتبار أن سلوك المرأة كفيل بتبني مفاهيم الترابط والتعدد، وبما أن التحليل البنيوي يمنح نظرة شاملة وديناميكية للظواهر، فإن البنية هي المفتاح الموضوعي لتحليل سلوك المرأة المجرمة. من هذا المنطلق قمنا بتفكيك عناصر البناء الأنثوي التي تتصل بأهم التحولات البيولوجية والتغيرات الاجتماعية التي تطرأ على الأنثى طوال دورة حياتها، وكل مرحلة يتجسد فيها الأصل البيولوجي للجنس الأنثوي يقابلها تغير في الأداء الوظيفي لنسق شخصيتها، وهو مايمثله المستوى النسقي ،لذا فإن دراسة جملة العلاقات المختلفة بين مكونات العناصر الحصرية للأنثى تمكننا من الفهم الموضوعي لاستعداداتها، ومع قوة الدافع التي تٌولده الظروف الداخلية والخارجية يتشكل الفعل الإجرامي وهو مايمثله المستوى البنائي، وقد توصلنا إلى أن البُنى الذاتية للمرأة تهيء لإستعداد إجرامي، أما البُنى الموضوعية فتقوم بإنتاجه . هنا ترسم ملامح مبدأ تقابل الطبيعة والثقافة في الكشف عن بنية إجرام المرأة.This paper investigates feminist crime, which has arisen in forensic science as an analytical approach to gender within a comprehensive human framework. Women's conduct is sufficient to adopt the notions of interdependence and pluralism, resulting in their comprehensive and relational installation. Since structural analysis provides a holistic and dynamic perspective of phenomenal, it is the objective key to analyze criminal woman’s behavior. Therefore, we deconstructed the anthropological correlates of feminist structure, which are linked to the essential biological and social changes that a female experiences throughout her life, with each phase of the female's biological origins correlating to a change in her personality functional performance. This is the systemic level. The study of the different relationships between the female’s exclusive components enables to objectively understand her preparations.and with the driving force the criminal act is produced.this is the structural level.here. features that meet nature and culture are drawn
