آليات الإشراف والرقابة لضمان نزاهة وشفافية الإنتخابات فـي الجزائر

Abstract

تلعب الإنتخابات دوراً أساسياً في مشاركة الشعب في ممارسة السلطة عن طريق إختيار ممثليه بكل حرية، إذ أن الإنتخابات الحرة والنزيهة أصبحت الوسيلة المشروعة للوصول إلى السلطة . لضمان نزاهة العمليات الإنتخابية عمل المؤسس الدستوري الجزائري على إستحداث الهيئة العليا المستقلة لمراقبة الإنتخابات من خلال التعديل الدستوري لسنة 2016 ضمن المادتين 193 و194 بغية ضمان نزاهة الإنتخابات وشفافيتها في كامل مراحلها، ونظـم صلاحياتها ومهامها وتشكيلتها بموجب القانون العضوي رقم 16/11، وبعد تجربتها خلال الإنتخابات التشريعية والمحلية لسنة 2017 أظهرت محدودية صلاحياتها، وضعف ضمانات إستقلاليتها. وبعد فشل الهيئة العليا المستقلة في إدارة إنتخابات نزيهة وشفافة تحقق طموح وأمال الشعب والطبقة السياسية، وبعد الأحداث التي شهدتها الجزائر منذ 22 فيفري 2019. أُنَشِئَت السلطة الوطنية المستقلة للإنتخابات بموجب القانون العضوي رقم 19/07 المؤرخ في 14/09/2019، تحضر وتشرف على الإنتخابات وتراقبها من إستدعاء الهيئة الناخبة إلى غاية الإعلان عن النتائج الأولية . تعالج هذه الورقة موضوع الإشراف ومراقبة الإنتخابات عن طريق كل من السلطة الوطنية المستقلة للإنتخابات المستحدثة بالقانون العضوي 19/07 وكذا الهيئة العليا المستقلة لمراقبة الإنتخابات التي أنشأها التعديل الدستوري لسنة 2016. Elections play a key role in people's participation in the exercise of authority by freely selecting its representatives, Free and fair elections have become the legitimate means to access authority. In order to guarantee the integrity of the electoral processes, the Algerian constitutional institution has developed the Independant Supreme Electoral Observation By amending the Constitution of 2016 under Articles 193 and 194 in order to guarantee the integrity and transparency of the elections in full phases , Its functions and composition were regulated by organic law 16/11, after experience during the local and legislative elections of 2017 it showed limited authority and weak guarantees of independence. After the failure of the Supreme Independant Commission to administrate fair and transparent elections, the aspirations of the people and of the political class have been fulfilled, and after the events in Algeria since 22 February 2019. The Independant National Electoral Authority was established by organic law. 19/07 of 14/09/2019, which prepare and supervises the elections and control them from calling the elector until the initial results are announced. This paper addresses the subject of supervision and election observation through both the National Independant Electoral Authority, created by organic law 19/07 and the Independant Supreme Electoral Observation Authority, established by the Constitutional Amendment of 2016.
