أثــر حكـم البـراءة على التعويـض

Abstract

تفصل يوميا المحاكم في ملفات مختلفة ويقف الضحايا والمتهمون سواء أمام محكمة الجنايات أو الجنح أو المخالفات، حسب طبيعة الجرم المرتكب وتتم متابعتهم على أساس التهمة المنسوبة إليهم، وحسب الوقائع والسلطة التقديرية للقاضي يتم تبرئة وإدانة الفاعل، لكن هذا لا يعني أن يحرم الضحية من التعويض. ومن خلال هذه الصفحات سأحاول إبراز كيف يفصل القضاء في هذه المسائل، لكي يعالج ولو القليل مما يلحق الضحايا من جراء الجرائم من أضرار مادية وأخرى معنوية وهذا ما يظهر فيه أنه طريقة للحفاظ على كرامة الآخرين وإيصال الحق إلى صاحبه ولو لم تقع معاقبة الفاعل على ما نسب إليه. إشكالية البحث: إذا قضت المحكمة ببراءة المدعى عليه، فهل لها أن تحكم عليه بالتعويض؟ The courts are held in various cases, every day. The victims and the accused are standing before the Court of assizes, misdemeanors or offenses courts, depending on the nature of the offense committed and prosecuted up on the basis of the charges against them, and according to the facts and discretion of the judge, upon which the perpetrator is acquitted and convicted. Through these pages, we will try to highlight how the judiciary is dispose these matters, so as to address even a little of the material and moral damage that harm the victims of the crimes, which shows that it is a way to preserve the dignity of others and the delivery of the right to the owner, even if the perpetrator is not punished for what is attributed to him. The research problematic: If the court acquitted the defendant, could it ruling on him compensation?
