احتفاظ الجزائر بحق منع الأجانب من الدخول إلى الإقليم الجزائري من منظور القانون 08-11

Abstract

رغم استيفاء الأجنبي للشروط القانونية التي تسمح بدخوله للإقليم الجزائري، إلا أنه ووفقا لأحكام القانون رقم 08-11 المؤرخ في 25 يونيو 2008 المتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها، قد يجد نفسه عرضة للمنع من الدخول، وهذا لاحتفاظ الدولة الجزائرية بحقها في المنع من الدخول للإقليم الجزائري حتى وإن كان الأجنبي حائزا لجميع الشروط القانونية التي تسمح له بالدخول. تهدف هذه الدراسة إلى توضيح مدى فعالية إجراء تمكين الدولة الجزائرية من احتفاظها بحق منع الأجنبي من الدخول إلى الإقليم الجزائري وتحصين هذا الأخير من الهجرة غير القانونية؛ وعليه تتضمن الدراسة تحليلا للنصوص القانونية المرتبطة بالموضوع ما جعلنا نستنتج أن المشرع الجزائري وتطبيقا لمبدأ السيادة الإقليمية قد وسع من صلاحيات الدولة على إقليمها، إذ مكنها من الاحتفاظ بحقها في منع الأجنبي من الدخول إلى إقليمها، وهو ما يساهم في تعزيز سياسة تحصين الإقليم الجزائري. Although the foreigner fulfills the legal conditions which allow him to enter Algerian territory, However, according to the provisions of Law No. 08-11 of June 25, 2008 relating to the conditions of entry, stay and movement of foreigners in Algeria, he may find himself subject to an entry ban, because the Algerian state maintains its right to prevent entry into Algerian territory, even if the foreigner has all the legal conditions that allow him to. This study aims to clarify the effectiveness of the procedure allowing the Algerian State to retain the right to prevent the foreigner from entering Algerian territory and to immunize the latter against illegal immigration;Consequently, the study includes an analysis of the legal texts relating to the subject, which led us to conclude that the Algerian legislator, in application of the principle of territorial sovereignty, extended the powers of the State on its territory, because it permit retains its right to prevent a foreigner from entering its territory, which contributes to strengthening the policy of fortification of Algerian territory.
