مكانة العقوبات البديلة في ترشيد السياسة العقابية المعاصرة

Abstract

تعتبر العقوبات والسياسة العقابية من الأمور الموجودة في كل الازمنة مع اختلاف اشكالها وانواعها واجناسها، إلا ان كل مجتمع له نسقه العقابي الخاص سواءً كان متطوراً أو متخلفاً حسب ظروفه ومتطلباته. ومن ثمرة العقوبات الحديثة في المنظومة العقابية هي العقوبات السالبة للحرية أو ما يعرف بالسجن، ومع تجارب البشر على تطبيق هذه العقوبة خاصة قصيرة المدة منها قد ظهر سلبياتها خاصة في الجانب الاجتماعي وإعادة تأهيل الجاني، وقد أصبح التفكير في إيجاد بدائل مناسبة تقوم مقام هذه العقوبات بدون أن تشكل تشويشاً على أهداف والفلسفة العقابية. فالعقوبات البديلة هي نتاج هذه الحركة والتطور في إعادة النظر لمجمل المنظومة الجنائية والاجتماعية وينبغي أن تكون في الحسبان تقدير مصلحة المجتمع.Sanctions and punitive policy are among the things that exist in all times with different forms, types and gender, However, every society has its own punitive pattern, whether it is developed or underdeveloped, according to its circumstances and requirements. One of the fruits of modern penalties in the penal system is the negative penalties for freedom, or what is known as imprisonment, and with the experiences of humans in applying this punishment, its negative aspects have appeared, especially in the social aspect and the rehabilitation of the perpetrator. Thinking about finding suitable alternatives has become the basis for these penalties without constituting a disturbance to the objectives of punishment and punitive philosophy, Alternative punishments are the product of this movement and the development in reviewing the entire criminal and social system and should take into account an appreciation of society's interest.
