أثر إنحلال الرابطة الزوجية على الجنسية المكتسبة بالزواج

Abstract

تعترف بعض القوانين ومنها قانون الجنسية الجزائري بموجب الأمر رقم 05/01 سنة 2005 المعدل والمتمم، باكتساب الجنسية الجزائرية بالزواج إلى جانب التجنس والإسترداد، وعليه يمكن للزوج الأجنبي أن يكتسب الجنسية الجزائرية بناء على عقد الزواج. غير أن هذا الزواج قد يتعرض للإنحلال، إما بسبب الطلاق أو الوفاة أو البطلان، وهو ما يثير مسألة تأثر الجنسية الناتجة عنه. Some laws, including the Algerian Nationality Law, under Ordinance No. 05/01 of 2005, amended and supplemented, recognize the acquisition of Algerian nationality through marriage, along with naturalization and restitution, and accordingly, a foreign spouse can acquire Algerian nationality based on the marriage contract. However, this marriage may be subject to dissolution, either due to divorce, death or nullity, which raises the issue of the resulting nationality being affected.
