إشكالات في مسؤولية متولي الرقابة

Abstract

إن رقابة متولي الرقابة إما أن تكون قانونية أو اتفاقية حتى تتحقق مسؤوليته. وقد كانت الرقابة القانونية محصورة بالخصوص في الأب والأم، في حين أخذت الرقابة الاتفاقية حيزًا واسعًا، لكن التطور الحاصل تشريعيًّا وقضائيًّا، جعل الرقابة القانونية تَبْرُزُ بشكل ملحوظ. أما الشخص الخاضع للرقابة، فإما أن يكون قاصرًا، وإما أن يكون ذا عاهة عقلية أو جسمية، لكن المشرع الجزائري لم يوضح المسألة بشكل دقيق، مما أثار عدة نقاط تستوجب التبيان، مثل: حالة القاصر المرشد، والزوجة القاصرة، وحالة مسؤولية أساتذة التعليم العالي عن أفعال الطلبة الذين لم يبلغوا سن الرشد، إضافة إلى مسألة طبيعة الحالة العقلية أو الجسمانية التي تستوجب الرقابة. The oversight of the supervisor is either legal or agreement until his responsibility is fulfilled. Legal oversight was particularly confined to the father and mother, while the agreement oversight took a wide scope, but the legislative and judicial development has made, the legal supervision becomes noticeably visible. As for the person who is subjected to supervision, either he/she is a minor, or mentally or physically handicapped. But the Algerian legislator did not clarify the issue precisely, which raised several points that need clarification, such as the status of the mentor minor, the minor wife, and the case of the responsibility of higher education teachers for The students actions who did not reach the age of majority, in addition to the question of the nature of the mental or physical state that requires supervision.
