Abstract

البحث في أساس مسؤولية الدولة عن حوادث الاستهلاك يقتضي الرجوع إلى المبادئ العامة التي لم تقف عند حدود المسؤولية على أساس الخطأ أو بدون خطأ ومبدأ المساواة أمام الأعباء العامة، بل توسعت لتشمل مبدأ التضامن الوطني والتأمين الإجباري. يأخذ أساس مسؤولية الدولة إما صورة فانونية أو إجتماعية حسب مركز الدولة من الحادث الاستهلاكي بصفتها متدخلة أوحارسة، لتلتزم بالتعويض في صورة حق أو منحة للمضرور تطبيقا لمسؤوليتها القانونية والاجتماعية والاقتصادية In order to find the basis of the responsibility of the state in consum-ption accidents, it is necessary to refer to general principles which have not stopped at the limits of responsibility on the basis of error or without error and to the principle of equality before public charges, but expanded to include the principle of national solidarity and compulsory insurance.
