أحكامُ بيعِ الطّبخةِ في الفقهِ الإسلاميِّ

Abstract

تناولْنا في هذا البحثِ نمطًا مستحدَثًا من أنماطِ البيعِ، يُسَمَّى في بعضِ الأسواقِ الجزائريّةِ بـ: بيعِ الطّبخةِ، وهو الذي يَجْرِي العملُ به حاليًّا -فيما وقفْنا عليه بعد تَتَبُّعٍ ميدانيٍّ- على نطاقِ واسعٍ. وبِعَرْضِهِ على أحكامِ البيعِ المقررَّةِ في الفقهِ الإسلاميِّ، توصّلْنا إلى أنّه: صورةٌ متكاملةٌ من صورِ التّعاملِ الرّبويّ؛ ذلك أنّه بمختلفِ حالاتِه لا يكادُ يخرجُ عن كَوْنِهِ شكلًا من أشكالِ الرّبا. Abstract: In this research, we will study a modernistic type of selling that has been called in some Algerian markets as "the Meal selling" and it has been widely used as we saw after field tracking. After exposing it to the provisions(rules) that have been istabilished and has been agreed upon in the Islamic jurisprudence, we found out that this type is one of the complete images of the usurious dealing because, no matter how different shapes it takes, it remains a kind of the sample usury.
