دعائم بناء الفتوى عند المالكية من خلال الدرر المكنونة في نوازل مازونة لأبي زكريا المازوني

Abstract

الملخص: دأب التصنيف في آداب الفتوى على تسليط الضوء على الجانب التنظيري والتمثيل له، على حساب مراعاة الشق العملي منها. وفي هذه الدراسة ومن خلال فتاوى الفقهاء المالكيين المبثوثة في ثنايا الدرر المكنونة في نوازل مازونة: سعيٌ لفكِّ هذه الإشكالية ببيان مدى استثمار التأصيل العلمي التنظيري لأدب الفتوى استثمارا تطبيقيا واقعيا، وفق دعائم إيمانية ومنهجية وعلمية ، تجلت من خلالها مكانة أصول المالكية وقوتها ومرونتها، ومدى مسايرتها لمختلف القضايا والنوازل. Abstract: The classification in the etiquette of the fatwa has always shed light on the theoretical side and inferred to it, at the expense of observing the practical part of it, and in this study and through the fatwas of the royal jurists present in the book Al-Durar Al-Maknoonah in Mazoonah issues: I seek to solve this problem by showing the extent of benefiting from the theoretical side, in practice and reality. On the basis of faith, scientific and discretionary foundations, it demonstrated the power, importance and flexibility of the owners' assets, and the extent of their handling of various issues.
