Abstract

The international community has recognized that the general international legal system is incapable of protecting the rights of persons with disabilities, leading to the adoption of the International Convention on the Rights of Persons with Disabilities and its Optional Protocol, which came to emphasize that persons with disabilities have the same rights as ordinary persons with certain extra rights. Enfin, nous avons conclu notre étude par quelques suggestions, peut-être les plus importantes sont lesquelles relier aux États qui ont ratifié la Convention, afin d’harmoniser leurs législations avec celle-ci. لقد أدرك المجتمع الدولي أن المنظومة القانونية الدولية العامة عاجزة عن حماية حقوق الأشخاص ذوي الإعاقة، مما أدى به إلى اعتماد الاتفاقية الدولية لحقوق الأشخاص ذوي الإعاقة وبروتوكولها الاختياري، والتي جاءت للتأكيد على أن للأشخاص ذوي الإعاقة نفس الحقوق التي يتمتع بها الأشخاص العاديين مع إيرادها لبعض الحقوق الخاصة بهم كالحق في التأهيل واعادة التأهيل. ولضمان حماية هذه الحقوق، تضمنت هذه الاتفاقية واتفاقيات عالمية واقليمية على آليات للحماية يمكن للأشخاص ذوي الإعاقة اللجوء إليها في حالة التعدي على أي حق من حقوقهم. هذه أهم المحاور التي تم تناولها في هذه الأطروحة، والتي شملت الإقرار الدولي لحقوق الأشخاص ذوي الإعاقة، ثم الكلام عن آليات حماية حقوق الأشخاص ذوي الإعاقة، وأخيرا اختتمنا دراستنا ببعض الاقتراحات لعل أهمها على الدول التي صادقت على الاتفاقية أن تعمل على جعل تشريعاتها متوائمة مع الاتفاقية.
