عقد مقاولة البناء ونظائره في الفقه الإسلامي

Abstract

الملخص: تهدف هذه الدراسة إلى بيان حقيقة عقد المقاولة وتكييفها الفقهي، والتمييز بينه وبين العقود ذات الصلة به، ومعرفة مدى قدرة الفقه الإسلامي على استيعاب المستجدات؛ لأجل هذا قسمت هذا البحث إلى أربعة مباحث، المبحث الأول تناولت فيه معنى عقد المقاولة وخصائصها، وجعلت المبحث الثاني للحديث في أنواع مقاولي البناء ودور المقاول وصاحب العمل في مقاولة البناء، أما المبحث الثالث فكان في التكييف الفقهي لعقد المقاولة وأدلة مشروعيته؛ و الرابع كان للتمييز بين عقد المقاولة والعقود التي لها صلة به وذلك بذكر نقاط التشابه والاختلاف، لنثبت أخيرا استقلالية هذا العقد عن غيره من العقود، وإن شاركه في بعض صفاته. Abstract: The purpose of this study is to clarify the reality of the contract of contract and its adaptation to jurisprudence, and to distinguish between it and related contracts, in order to raise the embarrassment of people and facilitate their lives, and to know the extent of Islamic jurisprudence to absorb the developments . For this purpose, this research was divided into four topics. The first topic dealt with the meaning of the contract and its characteristics, and then moved in the second section to talk about the types of construction contractors and their role in the building contracting. The third topic was in the juristic adaptation of the contract and the evidence of its legitimacy; Between contract of contract and related contracts by mentioning points of similarity and difference, to finally prove the independence of this contract from other contracts, although he participated in some of his qualities key words: Contracting; leasing; Istisnaa; salam; common hire.
