فقه الزكاة بين التوقيف ومراعاة المقاصد في النظر الاجتهادي

Abstract

هذا المقال محاولةٌ جادة لإيضاح معالم منهجٍ مثاليٍّ لدراسة مسائل فقه الزكاة، هذا المنهج يجمع بين القول بالتعبّد وبين مراعاة المقاصد على وجه لا يخلُّ أحدهما بالآخر، وذلك بتحديد مجال إعمال كل واحد منهما، ولتقرير هذا المُبتغَى فقد انتظم هذا المقال أربعةَ مطالبَ، كان الأول لتحديد المفاهيم، وخصصت الثاني لعرض الاتجاهات التي ظهرت في تناول مسائل الزكاة، وأبرزت في الثالث أهم معالم المنهج المرتضَى، وحتى لا تبقى الدراسة جافة ذكرت في المطلب الرابع بعض التطبيقات على ما مضى. Abstract: This article is a serious attempt to establish the ideal approach to study the issues of jurisprudence of Zakat (charity due), this approach combines the observance of worship and the observance of purposes in a way that does not prejudice each other, by determining the scope of each of them, This article was divided into four demands, the first to define concepts, and the second was devoted to the presentation of the trends that emerged in dealing with the issues of Zakat, and highlighted in the third the most important features of the méthodology favorites, and then accompanied by the last request, which contains examples of the application of the above. .
