Abstract

تتجلى أهمية الدستورالية في أنها استأثرت باهتمام الباحثين في القانون الدستوري في القارات الخمس، ذلك أنها تعبير عن حركة فقهية رافقت ظهور وانتشار الدساتير، حيث كانت في كل مرة تمد هذه الدساتير بالنقد اللازم، وبالأفكار التي تمكن الدول من احترام دساتيرها فعلا، بل إن الدستورالية صارت اليوم تطمح أن يصبح القاضي الدستوري أقوى من السلطة التنفيذية، وهذا تفاديا لكل ما يمكن أن يحدث إذا استأثرت السلطة التنفيذية وحدها على كل السلطاتconstitutionalism is very important theory wich has captured the attention of researchers in constitutional law on all continent. it is a doctrinal movement that accompanied constitutions since her emergence and in their spread. it provided all times constitutions with critics and ideas to be respected by states.
